En la rueda de prensa del Consejo de Ministros de este martes 6 de abril, el Ministro de Agricultura, Pesca y Alimentación, Luis Planas, ha manifestado la problemática que ha surgido en el campo cómo consecuencia de la crisis sanitaria ocasionada por el COVID-19, la cuál ha generado una escasez de mano de obra en el campo que se ha visto reducida a entre 75.000 y 80.000 personas, mano de obra que en años anteriores cubrían mayoritariamente temporeros extranjeros provenientes de países tales como Marruecos, Uruguay, Rumanía o Bulgaria.

En virtud de esa necesidad, denunciada por diversas asociaciones agrarias que manifiestan el peligro de desabastecimiento en caso de no resolver dicha escasez de mano obra producida tras la limitaciones a la movilidad establecidas en España y la mayoría de los países europeos, se ha anunciado la aprobación de un Real Decreto Ley que flexibilizará la contratación en el campo de cara a futuras campañas, especialmente en los meses entre marzo y de septiembre, cuándo se llevan a cabo numerosas tareas agrícolas, tales como las de recogida de las frutas de hueso, las fresas, entre otras frutas hortalizas.

El Real Decreto aprobado en el día de hoy, permitirá la incorporación de determinados colectivos a estos trabajos y establece medidas de proximidad, siendo así los trabajadores contratados los del término municipal o los colindantes, con el objeto de evitar al mínimo los desplazamientos, según ha manifestado el ministro.

Estas medidas se dirigirán en primer lugar a los parados, también a los que se encuentran actualmente cobrando un subsidio agrario o una renta agraria o prestación por desempleo, que podrán compatibilizar con el trabajo agrario. Adicionalmente, se dirige a los trabajadores extranjeros que se encuentre residiendo legalmente en España, pero cuyos permisos acaben antes el 30 de junio, así como a los jóvenes extranjeros entre 18 a 21 años, a los cuales se les facilitará el permiso de trabajo, o la prórroga del mismo, con el objetivo que se incorporen a estas tareas.

Manifiesta el ministro también que, de manera excepcional, se podrá compatibilizar estas prestaciones con la posibilidad de obtener ingresos a través de las tareas agrarias. A los trabajadores afectados por ERTE vinculados al coronavirus, no sería aplicable en este contexto.

El contrato de trabajo habrá de ser por escrito, en base al Convenio Laboral agrario, y para dotar de mayor transferencia, los salarios serán abonados mediante transferencia bancaria.

Cómo conclusión, y a la espera de su publicación por el BOE para su mayor estudio, lo regulado por el nuevo Real Decreto Ley supone para los extranjeros residentes en España contar con una oportunidad tanto para prorrogar sus contratos de trabajo para aquellos que estén a punto de finalizar como para facilitar su acceso al mercado laboral.
