Padres de menores españoles o comunitarios podrán solicitar la Tarjeta de residencia de familiar de comunitario

Aquellos ciudadanos extranjeros de países no comunitarios y que sean padres de un menor de edad de nacionalidad española o de otro país de la Unión Europea podrán solicitar una tarjeta de familiar de comunitario europeo. 

Hasta el momento, todas aquellos padres de menores españoles o de países comunitarios, venían accediendo a permisos de residencias por circunstancias excepcionales, en concreto, el Arraigo Familiar.

Esto supone una gran ventaja para los padres de menores españoles o comunitarios, dado que la residencia por Arraigo Familiar tiene una duración de un año, la cual ha de ser renovada sucesivamente, sin embargo, la residencia de familiar de comunitario tiene la duración de 5 años, la cual podrá ser renovada a su vez por la residencia permanente.

Por tanto, aquellos padres que no cuenten con residencia legal en España o inclusive, que estén gozando de una residencia por Arraigo familiar, podrán solicitar una tarjeta de residencia como familiar comunitario.

Para realizar dicha solicitud, los padres deberán acreditar los siguientes requisitos: 

  • Disponer de un seguro médico para sí mismo y sus familiares;
  • Demostrar contar con recursos económicos suficientes que garanticen que su estancia no supondrá una carga para el Estado. Cabe resaltar en este apartado, que la procedencia de estos medios no podrá suponer en ningún caso motivo de denegación de la solicitud.
  • En caso de padres de menor español, no sería necesario acreditar la disponibilidad de medios económicos ni tener la asistencia sanitaria cubierta. En principio, bastaría con acreditar la relación familiar con el menor español, convivir con él en España y carecer de antecedetes penales.
