Los solicitantes de asilo podrán obtener una autorización de residencia por causas excepcionales sin tener que renunciar a su expediente de demanda de protección internacional. Así lo ha informado este martes la secretaria de Estado de Migraciones, Hana Jalloul, la ha respondido favorablemente al Defensor del Pueblo a su recomendación formulada por vez primera en octubre de 2017, en la que se solicitaba la elaboración de una instrucción que clarificase la compatibilidad de los procedimientos de asilo con aquellos regulados en la legislación de extranjería. Concretamente, la petición de la Alta Institución tenía por finalidad terminar con las barreras a las que se enfrentaban hasta hoy aquellos solicitantes de asilo que, demandando residencia por circunstancias excepcionales, veían este trámite condicionado a la pérdida automática de su solicitud de asilo.

Así ha quedado plasmado en el escrito que el Ministerio de Inclusión, Seguridad Social y Migraciones ha hecho llegar al Defensor del Pueblo, Hana Jalloul recuerda que “el diseño e implementación de políticas inclusivas exige adoptar un enfoque flexible y personalizado”, capaz de poner “en primer lugar a la persona”, y esto, al amparo del artículo 10.1 de la Constitución española.

En el escrito que el Defensor del Pueblo había trasladado a la Secretaría de Estado de Migraciones se insistía en la naturaleza del colectivo en cuestión, siendo las personas refugiadas un grupo protegido por el derecho internacional. La recomendación que Hana Jalloul ha aceptado recordaba, además, las complejas circunstancias que rodean los itinerarios de vida de las personas que llegan a España en calidad de solicitantes de protección internacional. En este sentido, y aunque el procedimiento de extranjería y el que enmarca la protección internacional responden a dos realidades diferenciadas, la secretaria de Estado de Migraciones estima, en base al artículo 123 del Reglamento de extranjería, que los solicitantes de protección internacional pueden solicitar, por circunstancias excepcionales, una autorización de residencia temporal por razón de arraigo.

Además, en la respuesta emitida por la secretaria de Estado de Migraciones determina, en consonancia con el Defensor del Pueblo y para garantizar la protección que este colectivo precisa, que el hecho de que un demandante de protección internacional solicite por una circunstancia excepcional autorización de residencia, esto no podrá suponer en ningún caso su renuncia al procedimiento. Asimismo, dicha solicitud de autorización de residencia por arraigo en ningún caso podrá ser inadmitida a trámite, según establece la secretaria de Estado de Migraciones en consonancia con la disposición adicional 4ª del Reglamento de extranjería.
