En el días de hoy 2 de diciembre de 2020 se ha aprobado el Real Decreto 1049/2020, de 1 de diciembre, por el que se modifica el Reglamento por el que se regula el procedimiento para la adquisición de la nacionalidad española por residencia, aprobado por el Real Decreto 1004/2015, de 6 de noviembre.
Entre las novedades más destacadas se encuentra la posibilidad de presentar las pruebas objetivas tanto de diplomas de español como lengua extranjera (DELE), como de conocimientos constitucionales y socioculturales de España (CCSE), mediante medios electrónicos, cuestión de vital importancia en plena crisis del coronavirus.
Adjuntamos el Real Decreto 1049/2020, de 1 de diciembre, por el que se modifica el Reglamento por el que se regula el procedimiento para la adquisición de la nacionalidad española por residencia, aprobado por el Real Decreto 1004/2015, de 6 de noviembre, para más información.
Resumen:
Artículo único. Modificación del Reglamento por el que se regula el procedimiento para la adquisición de la nacionalidad española por residencia, aprobado por el Real Decreto 1004/2015, de 6 de noviembre.
Uno. El apartado 2 del artículo 6 del Reglamento por el que se regula el procedimiento para la adquisición de la nacionalidad española por residencia, aprobado por el Real Decreto 1004/2015, de 6 de noviembre, queda redactado en los siguientes términos:
«2. Ambas pruebas serán diseñadas y administradas por el Instituto Cervantes, de acuerdo con el penúltimo párrafo del número 3 de la disposición final séptima de la Ley 19/2015, de 13 de julio, de medidas de reforma administrativa en el ámbito de la Administración de Justicia y del Registro Civil, y con lo establecido en la normativa específica del Instituto Cervantes y en el Real Decreto 1137/2002, de 31 de octubre, por el que se regulan los diplomas de español como lengua extranjera (DELE).
Las pruebas serán presenciales, si bien podrán ser también administradas a distancia utilizando medios electrónicos que permitan comprobar la identidad de los interesados y el correcto desarrollo de las pruebas, en los supuestos y con los requisitos que determine el Instituto Cervantes».
Dos. El apartado 3 del artículo 6 del Reglamento por el que se regula el procedimiento para la adquisición de la nacionalidad española por residencia, aprobado por el Real Decreto 1004/2015, de 6 de noviembre, queda redactado en los siguientes términos:
«3. En todo caso, la prueba de conocimientos constitucionales y socioculturales de España estará formada por un sesenta por ciento de preguntas relativas a conocimientos sobre la Constitución y la organización administrativa y territorial de España y por un cuarenta por ciento de cuestiones sobre la cultura, la historia y la sociedad españolas. Todas las preguntas de esta prueba serán de respuesta cerrada y tendrán el mismo valor dentro del conjunto de la prueba, la cual se llevará a cabo, sin perjuicio de su realización a distancia en los términos establecidos en el apartado anterior, con carácter periódico en los centros de examen reconocidos por el Instituto Cervantes para realizarlas, debiendo estar aprobados y publicados, con carácter previo a las pruebas, los procedimientos y plazos para solicitud de revisión de calificaciones o reclamaciones».
