Este lunes 30 de noviembre la Secretaría de Estado de Migraciones en coordinación con el Ministerio de Interior, ha impulsado una serie de acciones para proteger la seguridad jurídica de las personas extrajeras. Entre una de estas medidas está la de establecer que través de un recordatorio que figurará en las resoluciones que expiden las Oficinas de Extranjería, se subrayará que la mera tenencia de dicha resolución produce plenos efectos frente a la administración y frente a terceros, y su eficacia no se encuentra condicionada a la obtención de la Tarjeta de Identificación de Extranjero (TIE)
Esta iniciativa del Ministerio de Inclusión, Seguridad Social y Migraciones permitirá que, durante el periodo de tiempo que transcurre entre que el ciudadano recibe la resolución de la Oficina de Extranjería y el momento en que obtiene la TIE, las personas extranjeras puedan continuar utilizando el documento expedido por la Oficina de Extranjería (que deberá ser presentado en la Comisaría para proceder a la obtención de la Tarjeta) para poder hacer valer ante terceros los derechos inherentes a esa autorización.
El objetivo de esta medida es trasladar tranquilidad a las personas que se encuentren a la espera de obtener cita para el trámite de huellas o de expedición de la TIE, recordando que si bien obtener la TIE es un derecho y una obligación para el ciudadano, podrán utilizar esa resolución que ya han recibido para los trámites en los que necesite acreditar su autorización
de residencia o trabajo, tanto frente a la administración como frente a terceros. La obtención de la Tarjeta de Identificación de Extranjero (TIE) es un derecho y una obligación para aquellos extranjeros a los que se haya expedido un visado o una autorización para permanecer en España por un período superior a seis meses.
El Ministerio ha solicitado a las Oficinas de Extranjería que reflejen, a partir de ahora, esta especificación en todas las resoluciones de concesión, tanto iniciales como de autorizaciones prorrogadas o renovadas. Asimismo, esta información se ha reflejado expresamente en la página web de la Sede Electrónica de la Secretaría de Estado de Administraciones Públicas en los trámites de toma de huellas, expedición de tarjeta y renovación de tarjeta de larga duración.
